1.3 These GTC apply exclusively to the sale of goods through our online shop unless expressly agreed otherwise.
1.4 A “consumer” is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or independent professional activity.
1.5 A “business” is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.
2. Conclusion of the Contract
2.1 The presentation of products in our online shop does not constitute a legally binding offer to conclude a purchase contract.
2.2 By clicking the order button, the customer submits a legally binding offer to purchase the goods contained in their shopping cart.
2.3 Before submitting the order, the customer can review and correct the information entered and the selected products.
2.4 After receiving the order, the customer will receive an automatic confirmation by email. This confirmation acknowledges receipt of the order and does not necessarily constitute acceptance of the customer’s offer.
2.5 The purchase contract is concluded when Xeya expressly accepts the order or dispatches the ordered goods, unless otherwise stated in the order confirmation.
2.6 If Xeya does not accept an order, the customer will be informed accordingly and any payments already made will be refunded without undue delay.
2.7 If a product unexpectedly becomes unavailable after conclusion of the contract and Xeya was unable to identify this before accepting the order, Xeya will inform the customer without undue delay. Any payment already made will be refunded without undue delay.
3. Products and Product Descriptions
3.1 We make reasonable efforts to ensure that our products and their characteristics are presented as accurately and completely as possible.
3.2 Due to differences between screens, devices and individual display settings, colours and certain product details may appear different from the actual product.
3.3 The agreed characteristics of the product are those stated in the relevant product description and otherwise agreed between Xeya and the customer.
3.4 Product designs, colours, packaging or other product details may be subject to reasonable changes provided that such changes do not affect the agreed characteristics of the product.
3.5 The customer’s statutory rights, including statutory rights in respect of defects, remain unaffected.
4. Prices and Shipping Costs
4.1 The prices displayed in our online shop at the time the order is placed shall apply.
4.2 Prices displayed to consumers include the applicable statutory VAT, unless expressly stated otherwise where legally permissible.
4.3 Additional shipping costs may apply. The applicable shipping costs will be displayed to the customer during the ordering process before the customer submits the binding order.
4.4 For deliveries to countries outside the European Union, additional import duties, taxes, customs charges or other fees may arise. Where such costs are payable by the customer, the customer will be informed in accordance with applicable law and the information provided during the ordering process.
4.5 Promotional offers, discounts and voucher codes may be subject to additional conditions. Any such conditions will be stated separately.
5. Payment
5.1 The payment methods available for a particular order will be displayed during the ordering process.
5.2 The purchase price is generally due immediately after conclusion of the contract unless otherwise stated for the selected payment method.
5.3 Payment may be processed through third-party payment service providers. Their own terms and conditions may apply to the payment services they provide.
5.4 Where a refund is due, Xeya will generally use the same payment method that the customer used for the original transaction, unless otherwise expressly agreed or another legally permissible method is required.
6. Delivery and Shipping
6.1 We deliver to the countries and regions indicated in our online shop.
6.2 Estimated delivery times are stated in the relevant product information or during the ordering process.
6.3 Unless expressly agreed otherwise, stated delivery times are estimates and do not constitute guaranteed delivery dates.
6.4 If delivery is delayed due to circumstances outside our reasonable control, including delays caused by shipping providers, customs authorities or force majeure events, Xeya will inform the customer where reasonably possible.
6.5 The customer’s statutory rights in the event of delayed delivery remain unaffected.
6.6 In consumer sales, the risk of accidental loss or accidental deterioration of the goods generally passes to the consumer only upon delivery of the goods to the consumer or to a third party designated by the consumer who is not the carrier, subject to applicable statutory exceptions.
7. Retention of Title
7.1 The goods remain the property of Xeya until the purchase price has been paid in full.
7.2 In transactions with consumers, this retention of title applies only to the extent permitted by applicable law.

8.2 The details of the statutory right of withdrawal are set out in our separate Withdrawal Policy / Right of Withdrawal Notice.

12.2 Discount codes may be subject to limitations, including an expiry date, minimum order value or restrictions to specific products.
12.3 Cash redemption of vouchers is excluded to the extent legally permissible and unless otherwise expressly stated.
